Banks are proactively soliciting homeowners for a mortgage loan modification

 

Servicers must proactively solicit a home-owner for a mortgage loan modification whose loan passes the pre-screen (the HAMP qualifiers). A servicer is deemed to have made a reasonable effort to solicit a home-owner if over a period of at least 30 calendar days they performed the following;

  • The servicer made a minimum of 4 phone calls to the last known number during different times of the day, and;
  •  The servicer sent 2 written notices to the last address, one certified mail or overnight delivery
